How presumptive taxation under Section 44ADA works
If you're a freelancer or consultant in a specified profession — software development and technical consultancy both qualify — Section 44ADA lets you skip maintaining detailed books of account and instead declare 50% of your gross receipts as taxable income, regardless of what you actually spent. For most freelancers whose real expenses are well under 50% of receipts, this works out favorably: you pay tax on a smaller declared income than a full profit-and-loss calculation would show, and you save the effort of tracking every expense.
Eligibility depends on how much of your income comes through digital and banking channels. If at least 95% of your receipts are digital (bank transfers, UPI, cheques — not cash), your threshold is ₹75 lakh in annual gross receipts. If more than 5% of your receipts are in cash, the threshold drops to ₹50 lakh. Exceed the applicable threshold and you can't use the presumptive scheme — you'd need to maintain full books and get them audited instead.
One rule that surprises a lot of first-time freelancers: advance tax under the presumptive scheme doesn't follow the usual quarterly installment schedule. Regular taxpayers pay advance tax in four installments across the year, but presumptive-scheme taxpayers pay their entire liability in one installment, due March 15. Missing this date means interest charges under Sections 234B and 234C, even if you eventually pay in full.
If your actual expenses are higher than 50% of your receipts — say you have significant equipment, software subscriptions, or contractor costs — it may be worth comparing the presumptive scheme against maintaining actual books, since a genuinely higher expense ratio could mean a lower tax bill outside the presumptive scheme. This calculator shows both side by side when you enter your actual expenses.
